This Acceptable Use Policy (“AUP”) is part of your agreement with Glitch and is incorporated by reference into our Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service.
This AUP applies to all tiers of the Service, including Hobby, Pro, Team, and Enterprise. Enterprise customers with a Master Service Agreement may have additional or modified acceptable-use terms; in case of conflict, the MSA controls.
1. Prohibited Activities
You may not use the Service to:
1.1. Illegal Activity
- Engage in any activity that violates applicable local, state, national, or international law or regulation.
- Facilitate, promote, or support illegal transactions.
1.2. Malicious Software and Security Threats
- Author, distribute, or deploy malware, ransomware, viruses, worms, trojans, or any code designed to damage, disrupt, or gain unauthorized access to computer systems.
- Conduct phishing, social engineering, or credential-harvesting attacks.
- Perform unauthorized security testing, penetration testing, or vulnerability scanning against systems you do not own or have explicit written permission to test.
1.3. Spam and Abuse
- Send unsolicited bulk messages, emails, or communications.
- Use the Service to generate spam content or automated messages at scale.
1.4. Harmful Content
- Generate, store, or distribute child sexual abuse material (CSAM). Discovery of CSAM will result in immediate account termination and reporting to the National Center for Missing and Exploited Children (NCMEC) and law enforcement.
- Generate content that promotes violence, terrorism, or self-harm.
1.5. Intellectual Property Infringement
- Use the Service to infringe on the copyrights, trademarks, or other intellectual property rights of others.
- Distribute copyrighted material without authorization.
- See also Terms of Service, Section 7 (DMCA).
1.6. Competitive AI Training
- Use the Software, its outputs, or data derived from the Service to build, train, or fine-tune a competing AI product or service without an executed commercial license that expressly permits such use.
- This restriction is consistent with LICENSE, Section 4(c).
1.7. Circumvention and Fraud
- Circumvent, disable, or interfere with rate limits, usage quotas, billing controls, or security features of the Service.
- Use automated means to create accounts, generate fraudulent usage, or manipulate billing.
- Share paid-tier account credentials or access with unauthorized individuals. Team-tier seats are assigned to named individuals.
1.8. System Integrity
- Attempt to probe, scan, or test the vulnerability of the Service or any related system or network without express written permission.
- Interfere with or disrupt the integrity or performance of the Service or the data contained within it.
- Access any part of the Service through unauthorized means (e.g., scraping, reverse engineering beyond what is permitted by applicable law).
2. Abuse Reporting
If you become aware of any violation of this AUP, please report it to:
- Email:
abuse@heyglitch.ai
2.1. Response SLA
| Severity | Definition | Response time |
|---|---|---|
| P0 | Imminent danger, CSAM, active security breach, legal obligation | 24 hours |
| P1 | Malware distribution, phishing, repeated spam, IP infringement | 48 hours |
| P2 | Account sharing, rate-limit circumvention, minor policy violations | 5 business days |
Response time means initial acknowledgment and triage. Full resolution may take longer depending on complexity and may require cooperation from the account holder.
3. Enforcement
We apply a graduated enforcement process for AUP violations:
3.1. Enforcement Ladder
| Step | Action | When applied |
|---|---|---|
| 1. Warning | Written notice via email identifying the violation and required corrective action | First minor offense; pattern not yet established |
| 2. Temporary suspension | Account access suspended for a defined period (typically 7-30 days) | Repeated minor offenses, or first moderate offense |
| 3. Termination | Account permanently terminated; all data made available for export for 30 days per ToS Section 11.3 | Repeated or egregious violations |
| 4. Refund withheld | Pro-tier 14-day refund right is forfeited; Team/Enterprise billing terms apply per contract | Material breach of these Terms, including this AUP |
3.2. Immediate Action
We reserve the right to skip any step and take immediate action (including termination without prior warning) for egregious violations, including but not limited to:
- CSAM
- Active malware distribution
- Conduct that poses an immediate threat to the safety of others or the integrity of the Service
3.3. Appeals
If you believe enforcement action was taken in error, you may appeal by
emailing appeals@heyglitch.ai within 14 days of the action. We will review
and respond within 10 business days.
4. Monitoring
We do not proactively monitor Your Content (as defined in the Terms of Service, Section 5.1). However, we may investigate specific accounts in response to:
- Reports submitted via
abuse@heyglitch.ai - Automated detection of anomalous usage patterns (e.g., rate-limit circumvention, billing anomalies)
- Legal process or law-enforcement requests
Investigation may include reviewing account metadata, usage logs, and (where legally required and with appropriate process) content associated with the account.
5. Changes
We may update this AUP from time to time. Material changes will be posted at
heyglitch.ai/acceptable-use with at least 30 days’ advance notice and
noted in the Changelog below. Continued use of the Service after
the notice period constitutes acceptance.
